This study analyzed the procedural treatment given to mothers incarcerated at the Paraná Women's Penitentiary, located in Piraquara. It was developed at the Legal and Social Research Center of Universidade Positivo - CPJUS. This is an empirical research with the purpose of analyzing the treatment given to pregnant women and mothers in prison in the light of the collective HC 143.641/SP that appreciated the substitution of preventive prison by home detention for pregnant women, mothers of children up to 12 years old or disabled. The methodology adopted was quantitative, of documentary character, and the process flow analysis technique was used in 177 processes referring to the 190 mothers who were incarcerated on november/2018. Among the data collected, it was observed that 91.5% of women were mothers of children under 12 years old, but this information appeared in only 71% of the cases. In addition, in 67% of the cases there was no request for provisional release/house arrest made by the defense mentioning the fact that this woman is a mother or pregnant woman. Among the requests formulated, 69% were rejected or did not reach a decision. Furthermore, it was found that 46% of the incarcerated mothers committed crimes related to Law 11.343/06, 31% were arrested for theft and 13% committed homicide. From the data collected it can be concluded that the collective HC 143.641 / SP had a low impact on their extrication.
